Medinzy Health Service — Terms & Conditions
1. Introduction
- Medinzy Health Service provides home and facility-based healthcare services, medical equipment sales and rentals, and telehealth consultations. By using Medinzy’s services or placing orders for equipment, you (the “Client”) accept these Terms & Conditions.
2. Definitions
- • “Client”: patient or the patient’s legal guardian or authorized representative. • “Medinzy”, “we”, “our”, or “us”: Medinzy Health Service. • “Services”: physician visits, nursing, physiotherapy, telehealth consultations, diagnostics, and other medical support offered by Medinzy. • “Equipment”: medical devices, consumables, and accessories sold or rented by Medinzy.
3. Authorization and Consent
- • By availing Medinzy’s Services, the Client authorizes Medinzy and its authorized healthcare professionals to provide consultation, evaluation, testing, diagnosis, treatment, and related care at home or in a hospital setting as required. • The Client authorizes Medinzy to administer medications as prescribed by the primary treating physician. The Client acknowledges that potential risks and side effects have been explained by the treating physician or Medinzy’s medical professionals. • Medinzy will exercise reasonable skill and care in providing Services, but Medinzy and its staff are not liable for adverse outcomes resulting from medical treatments carried out under the direction of the Client’s treating physician, except in cases of proven negligence by Medinzy.
4. Medical Information and Privacy
- • The Client consents to the collection, storage and sharing of medical records and clinical information (including laboratory reports, radiology, hospital records, and other relevant documents) by Medinzy for the purpose of providing and coordinating care. • Medinzy will handle protected health information in accordance with applicable privacy laws and its privacy policy. Medinzy may share medical information with other healthcare providers involved in the Client’s care.
5. Emergency and Additional Treatment
- • Medinzy’s clinicians are authorized to provide additional or emergency care if necessary during an episode of care. In a medical emergency, Medinzy may arrange or recommend urgent hospital transfer or additional interventions. • The Client agrees to be responsible for charges arising from emergency or additional treatment, including hospital care and ambulance charges, unless otherwise agreed or covered by insurance.• It is the Client’s responsibility to arrange for hospital transfer if advised by the treating physician or Medinzy clinician. Medinzy may assist in arranging transfers, but is not liable for delays beyond its control.
6. Telehealth / Virtual Consultations
- Iqonic Design does not process any order payments through the website. All payments are processed securely through RazorPay and Stripe, a third party online payment providers.
7. Legal Guardian and Consent for Minors or Dependents
- • If Services are provided for a minor or dependent, the person signing this agreement confirms they are the legal guardian or authorized representative and have authority to consent to medical care on the patient’s behalf.
8. Insurance and Coverage
- • Medinzy does not guarantee that Services or equipment will be covered by any insurer. The Client is responsible for confirming coverage with their insurer and for payment of fees not covered by insurance.
9. Amendment and Withdrawal of Consent
- • This consent and these Terms remain in effect until withdrawn in writing by the Client. • Medinzy may update or amend these Terms periodically; updated Terms will be posted on Medinzy’s website or communicated to Clients. Continued use of Services after changes constitutes acceptance of the updated Terms.
10. Payment Terms
- • All fees for Services and equipment rentals/purchases are as quoted at the time of order and are payable as specified on the invoice. • Advance payment or deposits may be required for Services and are due prior to service delivery as stated at the time of booking. • Emergency or incidental deposits may be collected and will be refunded after account reconciliation, subject to deductions for charges incurred. • Clients are responsible for additional costs, including consumables, transportation, installation charges, taxes, and any other itemized charges. • Applicable taxes will be added to invoices and are payable by the Client.
11. Cancellation, Termination and Refunds
- • Either party may cancel Services or orders by providing the notice period stated for the specific service or product. Notice periods may vary by service type and will be communicated at time of booking. • Refunds (where applicable) will be processed within 7–10 business days of completed cancellation and receipt of required documents, subject to deductions per these Terms. • For rentals, early termination may not result in a refund of prepaid usage charges unless otherwise agreed in writing.
12. Medical Equipment Sales and Rentals
- • Medinzy sells and rents medical equipment to the public; purchases and rentals can be made independently of any homecare Service. • Equipment types include mobility aids, respiratory devices, hospital cots, mattresses, pumps, monitors, and related accessories and consumables. • For rentals, minimum rental periods, deposits, and advance payment terms will be specified in the rental agreement.
13. Delivery, Installation and Setup
- • Medinzy or its authorized representatives will deliver and install equipment as per the delivery schedule. Setup and demonstration will be provided by trained personnel where applicable. • Clients should not open sealed packaging prior to installation by Medinzy personnel when installation is included. • For certain cities, delivery may be in-person; for others, equipment may be shipped with remote setup support. • Clients may be required to present a valid prescription for certain equipment at the time of installation.
14. Relocation and Return of Rental Equipment
- • Relocation of rented equipment within the same city is available for a nominal fee and requires prior notice and proof of new address. Relocation to another city is subject to Medinzy’s presence and availability in that city. • Clients should not relocate equipment themselves; damages due to unauthorized relocation will be charged to the Client. • At contract end, Medinzy will schedule pick-up. The Client should prepare equipment as instructed (cleaning, disconnecting, emptying reservoirs, providing original packaging). Damages found on inspection may be deducted from the deposit.
15. Order Modification and Cancellation (Equipment)
- • Orders may be modified prior to installation or delivery. Changes may affect delivery timing and charges. • Cancellation is permitted before delivery without additional charges unless stated otherwise. Once equipment has been delivered and accepted or used, cancellation may not be possible and charges may apply. • Returns are accepted only for major defects or non-functionality and must be reported within 48 hours of delivery or installation. Consumables and disposable items are non-returnable.
16. Usage Duration and Extensions
- • Rental minimum periods apply (e.g., minimum two-week rental); beyond the minimum, charges are typically billed weekly or as specified. • Clients may extend rental agreements by providing required notice before the contract end; extensions will be documented in a revised agreement. • Early termination typically does not entitle the Client to a refund of prepaid usage charges unless specified.
17. Repair, Maintenance and Support
- • Equipment sold by Medinzy is covered by the manufacturer’s (OEM) warranty. Medinzy does not generally provide OEM-level repairs or spare parts; Clients should contact OEM support for warranty repairs. • For rental equipment, Medinzy provides maintenance support and may offer swap-out services for defective machines to avoid service disruption. Swap out timing depends on availability. • Technical support for equipment is available via customer support channels; field visits by biomedical engineers may be chargeable unless covered by warranty or rental terms.
18. Payments, Methods and Finance Options
- • Accepted payment methods and limits will be published on Medinzy’s website and may include cards, net banking, NEFT, cheque, and limited cash payments. • Cash payments may be subject to a cap and require identification documentation per regulations. • Medinzy does not provide loans directly; third-party finance partners may be available for purchases and are governed by separate agreements.
19. Deposits and Refunds (Rental)
- • Refundable deposits for rentals are held until equipment is returned and inspected. If equipment passes inspection and all dues are cleared, the deposit will be refunded via NEFT or other applicable method within the period specified at booking (typically up to 7 working days). • Deductions may be made for damage, missing parts, outstanding charges, or usage beyond the agreed term.
20. Returned Cheques and Payment Failures
- • Dishonored cheques or failed payments may incur administrative charges as specified on the invoice.
21. Liability and Indemnity
- • Medinzy will provide Services with reasonable care and skill. However, Medinzy is not liable for: • Acts or omissions of third-party providers or hospitals. • Adverse outcomes resulting from the nature of medical treatment when care was provided in accordance with accepted medical practice. • Loss or damage arising from Client’s misuse, negligence, unauthorized relocation of equipment, or failure to follow instructions. • The Client agrees to indemnify and hold Medinzy harmless from claims arising out of the Client’s breach of these Terms, misuse of equipment, or provision of false information.
22. Limitations on Critical Care
- • Medinzy does not provide full intensive care unit (ICU) services, critical-care hospital equivalents, or ambulance services. Medinzy is not a substitute for in hospital intensive care. In case of medical emergencies, Clients should seek immediate hospital care.
23. Complaints and Customer Support
- • For queries, complaints, or support, Clients may contact Medinzy’s customer care during specified hours via the contact details provided at booking and on the website. • Medinzy will investigate complaints and respond within a reasonable timeframe.
24. Governing Law and Dispute Resolution
- • These Terms are governed by the laws of the jurisdiction in which Medinzy is registered and operates. Disputes shall be resolved as specified in Medinzy’s dispute resolution policy (e.g., negotiation, mediation, and/or arbitration) or as required by applicable law.
25. Miscellaneous
- • The usage agreement for rented equipment is non-transferable unless expressly agreed in writing by Medinzy. • Any waiver of rights by Medinzy must be in writing. • If any provision of these Terms is found invalid, the remaining provisions remain enforceable.
